Before confirming your order, please read through our Terms & Conditions and print a copy for future reference.
By placing an order, you agree to be legally bound by these T&C’s.
We reserve the right to refuse to accept any order at our discretion.
We reserve the right to add to and/or amend the T&C’s, or any part thereof, as and when necessary, and without prior notification.
Ordering/Payment
Nicci’s Cakes usually ask for your initial order request to be at least 14 days prior to the date the cake is required. If an order is requested and accepted within the 14 days window, the full balance will become due immediately.
Any order will only be confirmed via email at which point the deposit/balance will become due.
It is your responsibility to read and check the quote thoroughly prior to the deposit being made.
For all other balances, payments outstanding should be made no later than 14 days prior to the date of collection unless otherwise agreed with Nicci’s Cakes.
The price quoted for the order will be the price payable. Your order may not be amended or cancelled within 14 days of the arranged collection date, however, at our discretion, this period may be reduced to 7 days.
Any monies outstanding will immediately become due if any amendments or cancellations are made within this time period. Any monies, including deposits already paid are non-refundable if cancelled within the timeframe set out above.
Deposits
All orders require a deposit which are both non-transferable and non-refundable. All deposits become due when the order has been placed or agreed by you. Deposits can be paid by cash or bank transfer.
Paying your deposit secures your booking and the price and prevents any further price increases, except in exceptional circumstances beyond our control e.g exceptional fuel price increases.
Collection/Delivery
A time and date will be agreed for collection/delivery of your order. If collection/delivery time needs to be changed, Nicci’s Cakes must be notified by telephone or email as soon as possible and at least 48 hours before either the new or previous collection time, whichever is the earlier.
On collection/delivery of your order, Nicci’s Cakes will advise of any non-edible elements of your cake. It is your responsibility to ensure all recipients/consumers of the cake are made fully aware of these and these items are removed by you, your caterers or guests prior to consumption e.g support dowels in tiered cakes, ribbons, wires in sugar work etc.
All collected orders are stored and transported at your own risk. Nicci’s cakes will advise on both acceptable storage and transportation methods, however, Nicci’s Cakes are not responsible for any damage/spoilage once your order has been collected.
Delivery charge is calculated on a mileage and time basis if this option is requested. It is our intention to deliver your cake in perfect condition prior to the start of your event (at a mutually agreed time), however, we ask for patience with factors that may be out of our control e.g traffic conditions, as we cannot be held liable for any such delays. It is your responsibility to ensure we are provided with the correct address for the venue, date and start time.
It is your responsibility to ensure arrangements are made for the cake table, linen, cake stand and knife to be set up prior to our arrival (unless prior arrangement agreed for us to liaise directly with the venue). We reserve the right to charge for any delays caused to us in the event that this is not the case. Please take extra care to ensure the cake table is adequately secure and stable prior to delivery.
Non-Payments
A quote once provided, is valid for a maximum of 48 hours, unless a longer timescale is agreed with Nicci’s Cakes, at which point the deposit must be paid in order to secure the booking. Failure to pay the deposit (within the 48 hours or at the agreed future date) will result in the booking being cancelled.
In the event that any payment is subsequently declined, the order will not be released or completed until alternative funding arrangements have been agreed and payment made in full.
Subsequent completion of the order will be subject to availability and cannot be guaranteed. Nicci’s Cakes accepts no liability for any loss whatsoever caused by non-delivery under these circumstances.
The customer will be responsible for the payment of any additional charges which have been incurred as a result of payment failure.
Cancellations/Refunds
As your order booking is reserved solely for you and decorations would have been made in advance, deposits paid are non-refundable. The balance will become due if the order is cancelled within 14 days of the delivery/collection date. We may, at our discretion, reduce this period to 7 days. Prior to this a refund of any monies paid, less deposit, will be made.
All cancellations must be made in writing.
Any issues identified post delivery/collection must be made immediately in writing, plus full cake and packaging returned within the 24 hour window after delivery / collection, for the issue to be investigated. At which point it will be at the discretion of Nicci’s Cakes as to whether any refund will be made.
In the unlikely event that an order has to be cancelled by Nicci’s Cakes all monies paid will be refunded.
Design
Please note any cake created will be produced as an interpretation of the requested design and will not be an exact reproduction.
We recommend caution on some cake designs during the summer months which may be prone to melting. Please feel free to ask for guidance on alternatives. We cannot accept responsibility for any melting of the cake once it has left our possession as we have no control over the environment/venue temperature.
Nicci's cakes will only use non-toxic food safe items on your cake. Please feel free to ask for guidance if you are unsure if an item is food safe. We reserve the right to refuse to add items which are deemed non-food safe and accept no responsibility for these or any other items which are added by yourself, venue or florist etc.
Allergies/Special Dietary Requirements
Baked goods by Nicci’s Cakes are not allergy free. They may contain, or contain traces of, dairy, eggs, nuts, wheat, soya or other likely allergens.
Please discuss with us any dietary requirements as cakes can be made gluten/milk/egg free by request. However, please be aware that although these ingredients may have been removed from the cakes, they are still used in our kitchen, therefore we cannot guarantee that any of our cakes are completely free of all traces for people who are highly sensitive.
Please be aware It is your responsibility to ensure all recipients and consumers of the product are made fully aware of this information.
Nicci’s Cakes and will not be held responsible for any allergic reactions arising from our products.
